What happens if we can’t agree where the children should live ?

These circumstances are inherently difficult, with emotions often running high. First and foremost, it is vital to always try to put the interests of the children first. If you can’t agree, perhaps consider mediation, but this does need willingness to participate from both parents. If all else fails, the court will have to decide where the children should live and the court will always put the interests of the children first.

Can I stop my partner seeing the children ?

This question in turn depends on whether both parents have parental responsibility as of legal right. The starting point also is a legal presumption that a child will benefit from seeing both parents but clearly this can be overruled by abusive behaviour of a parent either physically or mentally. In those circumstances, restrictions on contact can be ordered by the courts.
