FAQs about Employment Law

How long after dismissal do I have to start a claim for Unfair Dismissal ?

You will have 3 months less 1 day from the effective date of termination, this applies to claims for both unfair or constructive dismissal. If you miss the deadline, subject to certain arguments you may put forward (don’t rely on this), you will lose your right to pursue a claim for unfair dismissal or constructive dismissal.

I have a grievance, what can I do ?

Be aware furstly that in pure practical terms, taking any kind of formal action  such as traising a grievance, rightly or wrongly can lead to an escalation and termination of employment in the future. We are in no way saying that you should accept any inapprpriate actions or conduct by your employers or colleagues, we are simnply stating our experience.

If you do wish to take some action, always check your contract and any policies and procedures first. You need to comply with any procedures and so will your employers. It is generally, where possible, worth seeking to resolve any issues informally first, but do keep records of any meetings and record in writing where possible.
